Terms and Conditions of Purchase

Welcome to Acrament’Bon's website, a Canadian company incorporated under the Quebec Business Corporations Act. All users of this site agree that access to and use of this site are subject to the following general terms and conditions and any other applicable law. Use of this site constitutes your approval. If you do not agree with these general terms and conditions, please do not use the Acrament’Bon site.

This document constitutes a contract (the "Agreement") between you ("you", "your") and Acrament’Bon ("Acrament’Bon", "we", "our") concerning the terms and conditions associated with ordering and receiving our products ("Products") offered to you as one-time Product purchases, through the "acramentbon.com" website, as well as any related subdomain or any other connected mobile platform (the "Website", the "Service"). You must read the following terms and conditions of purchase before using the Service.

By accessing the Website or using the Service, you accept all terms described in this Agreement. You can cancel this Agreement at any time by ceasing to use the Service in accordance with the terms described in this Agreement.

Terms of Sale

The Services are offered as one-time Product purchases.

Order Modification

Orders can be modified or canceled up to 4 hours after purchase.

Once the order is being prepared, no modifications are possible.

Out of Stock

Acrament’Bon attempts to maintain an up-to-date inventory. If we experience an out-of-stock situation, Acrament’Bon commits to notifying you within a reasonable timeframe. Options for returning the sold-out product, product replacement, or refund will be offered to you.

Delivery

Currently, Acrament’Bon does not deliver everywhere in Quebec. When you place your order, our system will automatically indicate if delivery is possible to your address.

Pricing

Acrament’Bon reserves the right to change its prices at any time.

How One-Time Purchase Works

A one-time purchase of Acrament’Bon Products is a single purchase with no automatic renewal option.

Accounts, Passwords, and Security

When making a one-time purchase of Products, you must open an account to use the site and/or services. You must follow the registration process by providing Acrament’Bon with the requested up-to-date, complete, and accurate information.

You are entirely responsible for maintaining the security and confidentiality of your account and password. You are also entirely responsible for all activities that occur under your account, whether performed by you or by another person.

You agree to notify Acrament’Bon immediately of any unauthorized use of your account or any other security breach. Acrament’Bon will not be liable for any loss you incur if another person uses your password or account, whether you are aware of it or not.

However, you may be held liable for any loss suffered by Acrament’Bon or another party resulting from another person's use of your account, if such use results from your negligence regarding the security and confidentiality of your account.

Delivery Terms

Acrament’Bon generally uses third parties for shipping its Products; therefore, all Product purchases are governed by a shipping contract which stipulates that title and risk of loss for these Products are transferred to you when the Products are delivered to you.

Once the Products are delivered, their condition and consumption are your responsibility, and you are solely responsible for handling, storing, using, and consuming the Products properly and safely.

Acrament’Bon is not responsible for any action or omission on the part of these third parties and is not responsible for any delay or loss of any kind that occurs when an order is in the hands or under the control of a third party.

Shipping dates and times are estimates, and actual shipping dates and times may change due to weather conditions and other factors, some of which are beyond our control.

In the event of circumstances beyond our control that affect our ability to deliver the Products to you on your scheduled delivery date, we will attempt to deliver your Products as soon as possible.

A delivery notice will be sent to the email address linked to the account to inform you of possible delivery days, which are between Tuesday and Friday of each week.

Acrament’Bon will not be held responsible if the box is not collected at the location you specified in your account. We also commit to providing you with the necessary proof of delivery to support this.

Products are deemed delivered when the Product is delivered to the location indicated in accordance with the delivery instructions you specified when placing your order.

We assume that any person present at the address specified in the delivery instructions is authorized to receive the order on your behalf.

If no one is present at the address indicated in your delivery instructions, we will leave the package unattended at the address or location you specified. It is your responsibility to provide us with clear and complete delivery instructions.

It is your responsibility to inspect all Products you receive from us upon delivery for any damage or other issues. You are solely responsible for determining the integrity of the Products you receive.

Should a Product not be fresh, opened, or broken upon delivery, please notify us and we will handle this situation in accordance with our return and refund policy.

Once your Products are received and inspected, you must place them in the freezer.

Our boxes include thermal insulation and dry ice, preserving the Products for a period of 48 hours. Any degradation of the Products, including the passage of time, will be your responsibility once delivery is complete.

If you are unable to collect your order, it is your responsibility to find a solution to prevent the freshness of the Products from deteriorating.

When planning your deliveries and collecting your box, please consider the temperature in your region, as the outdoor temperature could impact the degradation of the Products.

Order, Exchange Rate, Taxes, and Payment Options

All prices are in Canadian dollars. Our products are not taxable. We accept all the following payments: credit card and prepaid card.

Orders placed on www.acramentbon.com are securely sent to our order office where they are reviewed. Once the order is verified and fully paid, it will be processed and delivered.

Customers agree to pay for goods and services purchased via the Acrament’Bon site and acknowledge that purchasing goods or services online is equivalent to purchases made in a physical store.

Health Disclaimer Notice

Acrament’Bon is not responsible for the abuse and/or misuse of any product sold as a result of a consumer using this website.

Acrament’Bon is also not responsible for any problems or difficulties that may arise due to the consumer's use of products sold by Acrament’Bon.

Customers using this website, past and future, who do not consult their healthcare professional before purchase and subsequent use of any product, assume the risk of all consequences.

Copyright

The entire content of this site, including text, but not limited to text, including graphics and codes, is protected by copyright law as a collective work under Canadian law and other copyright laws, and is the property of Acrament’Bon.

The collective work includes works authorized by Acrament’Bon.

This site, the materials and products on it are provided "as is," and without warranty of any kind, either express or implied.

To the fullest extent permissible pursuant to applicable law, Acrament’Bon disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.

Acrament’Bon does not represent or warrant that the functions contained in this site will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes the site available is free of viruses or other harmful components.

Acrament’Bon does not make any warranties or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise.

Some states do not permit limitations or exclusions on warranties, in these specific cases, the above limitations may not apply to you.

Limitation of Liability

Acrament’Bon shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Acrament’Bon has been advised of the possibility of such damages.

Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Customers who take advantage of products offered on Acrament’Bon's online store but originating from companies other than Acrament’Bon do so at their own risk and will not hold Acrament’Bon responsible in any way, including, but not limited to, health complications or other problems resulting from the use of these products.

Typographical Errors

In the event that an Acrament’Bon product is mistakenly listed at an incorrect price, Acrament’Bon reserves the right to refuse or cancel any orders placed for product listed at the incorrect price.

Acrament’Bon reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and charged to your credit card account.

In such a case, Acrament’Bon undertakes to issue a credit to your account by refunding your credit card for the amount of the pricing error.

Termination

These general terms and conditions apply to you upon your access to the site and/or completing your purchase process.

These general terms and conditions may be terminated by Acrament’Bon upon 60 days' written notice.

The provisions relating to copyrights, trademark, disclaimer, limitation of liability, indemnification, and miscellaneous, shall survive any termination of this Agreement.

Notification

Acrament’Bon may send you a notice via: email, SMS, a general notification on the site, or any other reliable method to the address you have provided to Acrament’Bon.

Miscellaneous

The use of this site shall be governed exclusively by the laws of the province of Quebec and Canada. You agree that any action or suit arising out of the use of the site or this Agreement, including, but not limited to, the purchase of the Products, shall be brought before the courts of the province of Quebec.

No failure to exercise or delay in exercising any right, remedy, power, or privilege on the part of Acrament’Bon arising out of this Agreement shall be construed or deemed as a waiver thereof; nor shall any single or partial exercise of any right, remedy, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.

Neither the course of conduct between the parties nor trade practice shall act to modify any of these general terms and conditions.

Acrament’Bon may assign its rights and duties under this Agreement to any party at any time without prior notice.

Use of Site

Harassment in any manner or form on the site by means of e-mail, blog, or by obscenity or abuse is strictly forbidden.

You may not upload, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.

You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

Security

Acrament’Bon works to protect the security of your personal information during its transmission during transactions through our secure system.

Acrament’Bon employees do not have access to your credit card information, as it is immediately encrypted when a transaction is completed.

Only the transaction management company with which Acrament’Bon does business receives this encrypted information.

Other personal information collected by Acrament’Bon is used to ship your order via carriers, to contact you if necessary, or to allow you to benefit from all opportunities and activities offered by Acrament’Bon.

It is possible at any time to request that your information be removed from our database.

Disclaimer of Participation

Acrament’Bon does not and cannot review all communications and materials posted to or created by users accessing the site, and is in no manner responsible for the content of these communications and materials.

You acknowledge that by providing you with the ability to view and distribute user-generated content on this site, Acrament’Bon is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on this site.

However, Acrament’Bon reserves the right to block or remove communications or materials that it determines to be: abusive, defamatory, obscene, fraudulent, deceptive, in violation of a copyright, trademark, or other intellectual property right of another, or offensive and unacceptable to Acrament’Bon in its sole discretion.

Indemnification

You agree to defend, indemnify, and hold harmless Acrament’Bon and its officers, directors, employees, agents, successors, and assigns from and against any losses, damages, liabilities, actions, judgments, interest, awards, penalties, fines, costs, or expenses of any kind arising out of or resulting from:

(i) any breach by you of any obligation, warranty, or representation set forth in this Agreement or (ii) any activity related to your account, negligent or wrongful conduct, by you or any other person accessing and/or using your Acrament’Bon account.

Third Party

To provide added value to our visitors, Acrament’Bon may link to sites operated by third parties.

However, even if the third party is affiliated with Acrament’Bon, the latter has no control over these linked sites, which have separate private information collection practices, independent of Acrament’Bon.

These linked sites are only for your convenience and therefore you access them at your own risk.

Refund Policy

Acrament’Bon does not grant refunds or returns for Products when they are not defective or expired at the time of delivery and for a period of 48 hours corresponding to the shelf life of our Product boxes.

No refunds or returns are therefore accepted specifically for the following reasons: misuse of the product, improper storage, inadequate handling, incorrect delivery address.

It is your responsibility to inspect the Products upon delivery to ensure that everything is compliant, without damage or risk to consumption.

You must also place the Products in the freezer without delay after receiving the Products. Beyond this period, you will be presumed to have received the Products in good condition for consumption and non-defective.

If the delivered Product is defective, expired or incomplete at the time of delivery, Acrament’Bon undertakes to send you a new Product the following week, free of charge.

It is your duty to contact customer service to report the condition of the Product, within 3 business days of delivery, with supporting evidence.

You may be asked to keep the expired or defective Product for disposal. If a refund is necessary, depending on the situation, it may be issued to the same credit card used for the order.

If you are not satisfied with the Product or the online delivery service, we invite you to contact customer service directly at acramentbon@gmail.com.

Cancellation Policy

One-time purchase

For one-time purchases, you can cancel your order at any time before it is shipped. The amount charged to your credit card will be refunded to you.

After it has been shipped, you can no longer cancel your order and the refund policy applies, see above.
